The present writ petition under Article 226 of the Constitution of India read with Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has filed by the petitioner seeking modification of the order dated 01.04.2025 F. 10(003717640)/CJ/LEGAL/PHQ/2025/618 passed by the DG (Prisons) dismissing the application for release of the petitioner for release on furnishing personal bond and cash surety.

It is submitted that the second spell of Furlough was allowed on 11.02.2025 subject to the condition that the petitioner shall furnish personal bond with one surety for his release on Furlough to the satisfaction of the Jail Superintendent. The petitioner moved an application dated 15.03.2025 for modification of the order dated 11.02.2025 before the DG (Prisons) which was dismissed vide order dated 01.04.2025. It is submitted that the brother of the petitioner who earlier used to stand as surety has moved to other country in search of work and is now not available to come Delhi and stand as surety for the petitioner. The father of the petitioner is seriously ill and not in the condition to travel to Delhi. 4.

Hence the present petition has been filed.

Learned ASC for State accepts notice. He submits that the address of the petitioner stands verified.

In view of the submissions made, the order dated 11.02.2025 is modified to the extent that the petitioner be released on furnishing personal bond of Rs.10,000/- with one cash surety of the same amount. 7.

The petition is disposed of.
