The instant application has been filed on behalf of the applicant/petitioner under Section 439 of the Code of Criminal Procedure, 1973 (now Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023) seeking the following reliefs:
"a) to allow the present petition and admit the petitioner on bail in case FIR No.0214 dated 11.08.2018, under Section 420, 409, 34 IPq, P.S. Hauz Khas, District South, New Delhi; or b) If this Hon 'ble Court feels that petitioner is not entitled to regular bail at this stage he may be admitted on interim bail at least for a period of six months in view of the facts stated hereinabove."

he may be permitted to withdraw the instant application in view of the settlement arrived at between the parties vide order of the even date passed in W.P. (CRL) 3424/2024.

It is also submitted that the petitioner/applicant is in the Jail, therefore, he may be released in light of the said settlement and quashing of the FIR bearing No. 214/2018, dated 11th August, 2018, registered at Police Station - Hauz Khas, Delhi for offences punishable under Sections 420/409/34 of the Indian Penal Code, 1860.

Mr. Pandu Morimisetty, the petitioner/applicant appeared in person through video conferencing from the Central Jail No. 4, New Delhi. 5.
In light of the order of the even date passed in W.P. (CRL) 3424/2024 i.e., the connected matter, by virtue of which the aforesaid FIR and all the consequential proceedings emanating therefrom have been quashed, the instant bail application stands dismissed as withdrawn along with the pending applications, if any.

The concerned Central Jail No. 4, New Delhi is directed to release the inmate Mr. Pandu Morimisetty, the petitioner/applicant herein, if he is not warranted in any other cases at Bangalore, Central Jail. 7.
Copy of this order be sent to the concerned Superintendent Jail for compliance.
