The petitioner has preferred the present civil revision petition under Section 115 the Code of Civil Procedure, 1908, assailing the impugned order dated 14.03.2024 passed by the learned ACJARC(North-West), Rohini Courts, Delhi, whereby his application under Order 12 Rule 6 CPC, as also, another application under Section 65 of the Evidence Act for leading secondary evidence, have been dismissed.

None appeared on behalf of the respondents, despite sending advance notice.

Shorn off unnecessary details, the petitioner has filed a petition against the respondent seeking eviction under Section 14(1) (a) and (b) of the Delhi Rent Control Act, 1958. It is acknowledged by the learned counsel for the petitioner that the stage is set for addressing final arguments.

That being the case, the petitioner may address submissions with regard to any admission on the part of the respondent with regard to his claim as also lay down foundation for consideration of secondary evidence as per the law before the learned Trial Court. 7.

At this stage, learned counsel for the petitioner submits that he may be allowed to withdraw the present civil revision petition with liberty to address appropriate arguments in accordance with law before the learned Trial Court.

Accordingly, the present civil revision petition is dismissed as withdrawn.
