O R D E R

The present petition has been filed by the petitioner, 'Rajput Jewellers Private Limited', a Company, stated to be registered under the Companies Act, 2013 on 23.05.2020. By way of the present petition, the petitioner seeks the following prayers:
"a) To issue an appropriate writ/order directing the Respondent to restrain the office of the Regional Director, Northern Division from passing any orders against the petitioner till the disposal of the Rectification application filed by the petitioner and the application of registration of trade marks is not decided by the Registrar of Trade Marks.
b) To pass such other and further orders as may deem fit and proper in the interest of justice."

It is submitted that prior to the incorporation of the petitioner company, Late Sh. Ramesh Rajput (promoter of the petitioner company), had a proprietorship firm in the name of M/s Rajput Jewellers, duly registered The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
with the Delhi Sales Tax Department. The registration of the petitioner company was effected upon submission of requisite forms and documents before the Registrar of Companies, pursuant to which registration under the name Rajput Jewellers Private Limited was duly granted. 3.
On 02.08.2024 a complaint came to be filed under Section 16(1)(b) of the Companies Act, 2013 before the Regional Director, Northern Division, Ministry of Company Affairs, on the basis that the complainant was the owner of a registered trademark 'Rajput Jewellers' vide trademark application no.4450815. The said complaint is presently pending consideration.

It is the case of the petitioner that the rival trademark asserted by the complainant was registered much after the incorporation of the petitioner company. The petitioner has also raised additional grounds in opposition to the said complaint.

Further, it is submitted on behalf of the petitioner that the the petitioner has filed a rectification application before the Trademark Registry seeking cancellation of the registration relied upon by the complainant. 6.
The present petition has been filed by the petitioner on the apprehension that the Regional Director, Northern Division would dispose of the complaint under Section 16(1)(b) of the Companies Act, 2013, without due consideration of the petitioner's submissions. 7.
There is no evident basis for the above apprehension. 8.
Be that as it may, the present petition is disposed of with a direction to the Regional Director to dispose of the aforesaid complaint under Section 16(1)(b) of the Companies Act, 2013, after duly considering all relevant aspects of the matter, including those articulated in the present writ petition. Let a hearing be granted by the Regional Director to the concerned parties and a reasoned order be passed.

Needless to say, the above exercise shall be subject to the legal rights and remedies of the petitioner and the complainant. 11.
