accommodate the petitioner as per her entitlement once the report from the Safdarjung Hospital is received.

The report from the Safdarjung Hospital has been placed on record, which clearly states that the petitioner is a diagnosed case of phyllodes tumors (benign) and has undergone wide local excision with sentinel lymph node biopsy. The patient is also advised to remain under follow up (risk of recurrences).

Mr. Trideep Pais, learned senior counsel for the petitioner contends from the policy of the Government that the change of floor is permissible in case of certain exigencies.

Having considered the submissions made by learned counsel for the parties, the Court finds that the case of the petitioner deserves to be reconsidered by the DDA keeping in mind the opinion of the medical board as well as the extant policy.

5.

Let the case of the petitioner be reconsidered sympathetically and with due expedition.

6.

Let the decision be taken by the respondent(s) within a period of four weeks from the date of receipt of copy of the order passed today. 7.

Let a copy of the medical report be supplied to both the parties by the Registry.

8.

With the aforesaid observations, the instant petition stands disposed of along with all pending applications.
