% 08.03.2017 Parties have entered into a settlement.

Learned counsel appearing for the petitioner submits that the petitioner will file an undertaking by means of an affidavit in the court within two weeks from today to vacate the tenanted premises being Shop No.3, E-31, Milap Nagar, Uttam Nagar, New Delhi-110059 on or before 31.3.2018. He will also give an undertaking to pay the user charges to the respondent @ Rs.7,000/- per month w.e.f. 01.03.2017 by the 10th day of each month regularly. The user charges for the month of March shall be paid within a week from today i.e, by the 20th of this month. For the subsequent months the user charges shall be paid by the 10th day of each month in advance. He will also undertake to pay the electricity and water charges for the premises during his occupation. He will also not induct any third party in the tenanted premises or cause any wilful damage to the tenanted premises. The affidavit/undertaking by the petitioner may be filed within two weeks from today.

Learned counsel appearing for the respondent submits that the respondent shall not execute the eviction order on or before 31.03.2018 in case an affidavit by way of undertaking is filed by the petitioner within two weeks from today.

Learned counsel appearing for the petitioner submits that in view of the above he does not press the present revision Petition. In case there is default in payment of user charges the respondent will be at liberty to approach this court to have the eviction order of the tenanted premises executed.

Petition is disposed of. All pending applications, if any, also stand disposed of.
