This is a joint application filed under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 ['CPC'] for recording of settlement arrived at between the plaintiff and the defendant.

The application has been duly signed by the authorised representatives of the plaintiff and defendant Company as also their respective counsel. The application is also supported by affidavits of the authorised representatives of the parties.

The terms of the settlement are mentioned in paragraph 3 of the application.

I have gone through the terms of the settlement and do not find the same to be unlawful.

The application is allowed.

In light of the order passed above, the present suit is decreed in terms of the abovesaid application. The application shall form part of the decree. 8.
The decree sheet be drawn up in above terms.

In view of the fact that the suit has been settled at an initial stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870. 10.
The pending application stands disposed of.
