The present suit has been filed by the Plaintiff/Rashtriya Virjanand Andh Kanya Vidyalaya Society which is a society registered under the Societies Registration Act, 1860, for a declaration that the Plaintiffs are in a valid control and management of the affairs of the Plaintiff/society and they will continue to be legally elected governing body of the Plaintiff/society. 2.

On 14.08.2024, notice of default was issued to the Plaintiffs by this Court. been returned as unserved as the concerned Secretary of Plaintiff No.1 has left the job in 2019 and the default notice to Plaintiff No.2 has also been returned as unserved as the concerned manager of Plaintiff No.2 has left the job. Plaintiff No.3 has been served, however, the learned Counsel for the Respondents states that he has passed away and the LRs of Plaintiff No.3 have not been brought on record.

The concerned persons who were responsible to contest the present suit are no longer in the Plaintiff/society. It transpires that the Plaintiff/society is not interested in prosecuting the present suit. 4.
