O R D E R

The present petition has been filed seeking anticipatory bail in connection with FIR No.317/2023 under Section 376 IPC registered at Police Station Fatehpur Beri.

The learned counsel for the petitioner invites the attention of the Court to the order dated 11.08.2023 to submit that the petitioner was granted interim protection by this Court subject to his joining the investigation. She submits that the petitioner has repeatedly joined investigation as and when directed by the I.O concerned.

The learned APP for the State, on instructions from the I.O, who is present in Court affirms the fact that the petitioner has joined the investigation and he is no more required for any further investigation. 4.

It is not in dispute that in the present case even the charge sheet has been filed after the completion of investigation without arresting the petitioner.

The learned counsel for the petitioner also submits that the prosecutrix has also filed a similar complaint against another individual on the basis of which another FIR under Section 376 IPC was registered at Gurugram. 6.

In view of the above, it is directed that in the event of petitioner being arrested, he be released on bail subject to his furnishing personal bond in the sum of Rs. 20,000/- and a surety bond of the like amount to the satisfaction of the Investigating Officer / Arresting Officer with further subject to the condition that he will join investigation as and when directed by the IO concerned.
