This is an application on behalf of the Plaintiff under Order XXIII Rule 1 of the CPC for withdrawal of the present suit. 2.

The instant suit is one for partition of suit property bearing House No.M-11A Malviya Nagar, New Delhi-110017 admeasuring 100 sq. yds.. 3.

A preliminary decree was passed on 27.11.2024 whereby the share of the Plaintiff was declared as 1/3rd in the suit property. The other Defendants who are siblings of the Plaintiff, were declared to be owners of 1/3rd area of the suit property.

It is stated that the Plaintiff does not intend to pursue the present suit and seeks withdrawal of the suit.
