This application has been filed by the applicant under Section 439 of the Code of Criminal Procedure, 1973 (in short, 'CrPC') seeking release on regular bail in FIR No.0840/2016 registered with the Police Station: Ranhola, West-District, Delhi under Sections 302/201/120B/34 of the Indian Penal Code, 1860 (in short, 'IPC'). 2.

The learned APP submits that only further cross-examination of the Investigating Officer (IO) remains to be recorded before the learned Trial Court.

Though the learned counsel for the petitioner submits that, as far as the petitioner is concerned, he has already cross-examined the IO and the IO is not appearing before the learned Trial Court for the last three dates, the learned APP, on instructions from the IO, submits that the IO was not aware of the dates before the learned Trial Court The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. and that he will now definitely appear before the learned Trial Court on the next date of hearing.

Keeping in view the above and the stage of the trial, the present bail application is disposed of, requesting the learned Trial Court to expedite the conclusion of the trial and make endeavor to conclude the same preferably within a period of three months from the first date of listing of the case before it post this order. 5.

In case there is a delay in conclusion of the trial, the applicant shall be at liberty to file an appropriate application seeking release on bail. Any such application filed, shall be considered by the learned Trial Court in accordance with law.
