This is a writ petition filed under Article 226 of the Constitution of India seeking the following reliefs :- "(a) To issue WRIT OF MANDAMUS against the respondents to stop the illegal construction which is being carried by the owner/builder upon the property bearing No.124/9 Main Gaushala Road, Kishan Garh Village, New Delhi-110070.

(b) To issue WRIT OF MANDAMUS against the respondents to demolish the illegal structure/ which has been raised by the builder/owner upon the property bearing No.124/9, Main Gaushala Road, Kishan Garh Village, New Delhi-110070..."

The affidavit filed by the respondent No. 2, namely South Delhi Municipal Corporation ("SDMC") shows that there are illegal and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. unauthorized construction over the property bearing No. No.124/9, Main Gaushala Road, Kishan Garh village, New Delhi-110070. 3.

Ms. Maan, learned counsel appears on behalf of the respondent No. 4 i.e. the owners of the aforesaid property and states that said respondent has already applied for compounding and on compounding, regularization of the additional construction made by the respondent No. 4 will be done.

In this view of the matter, the respondent No. 2 shall consider the application of the respondent No. 4 for compounding the deviations expeditiously and not later than 4 weeks from today by a speaking order and the deviations which are non-compoundable shall be demolished within 4 weeks thereafter.

A compliance affidavit shall be filed by the respondent No. 2 in the present petition, after 10 weeks from today with an advance copy to the learned counsel for the petitioner as well as the private respondents.

Needless to state, the parties are free to avail their legal remedies against any order passed by the respondent No. 2. 7.

In case any deviations are non-compoundable and demolition needs to be effected, the same shall be effected after a period of 10 days from the date of relevant orders passed by the MCD. 8.

The petition is disposed in the aforesaid terms, along with, pending applications, if any.
