% 28.10.2024 I.A. 43678/2024 (seeking clarification of the order dated 14.05.2024) 1.

This application has been filed on behalf of the plaintiffs seeking clarification of the order dated 14th May, 2024, whereby the suit was decreed under Order XXIII Rule 3 of the Code of Civil Procedure, 1908. 2.

In terms of paragraph 8 of the said order, the Court directed the Registry to refund the entire court fee in favour of the plaintiffs. 3.

Mr Samik Mukherjee, counsel appearing on behalf of the plaintiffs seeks that the entire court fee be refunded in favour of plaintiff no.2, which is an Indian company.

For the reasons stated in the application, paragraph 8 of the order dated 14th May, 2024 is modified to the following extent: "8. In view of the fact that parties have arrived at a compromise, the Registry is directed to issue a certificate for refund of full court fee, in favour of the Plaintiff No.2."
