Petition under Article 226 of the Constitution of India has been preferred on behalf of the petitioner with the following prayers: "(a) Issue a writ in the nature of mandamus or any other appropriate writ directing the R3 & R-4 to release the illegally and forcefully seized vehicle model Maruti Tour S CNG bearing registration no. DL1ZC6132 having chasis no. MA3EJKD1S00B98934 and engine no. K12MN2323243 to the Petitioner along with the papers.
(b) Directing the Respondent No(s).2 to 4 to pay the damages for daily wage losses in sum of Rs.3,000/- (Rupees W.P.(CRL) 1670/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Three Thousand) per day from the date of illegally seizure of the aforesaid vehicle i.e. 09-05-2024 till the date of handing over the possession of aforesaid vehicle and its documents to the Petitioner.
(c) May further direct the Respondent No(s). 1 to 4 to pay Compensation in sum of Rs.1,00,000/- (Rupees One Lacs Only) on account of mental agony/ harassment/ inconvenience/physical and mental trauma caused by the illegal acts of Respondent No(s).2 to 4, (d) May further issue a writ in the nature of mandamus or any other appropriate writ may directing to the Respondent No(s).1 & 2 to take appropriate legal action against the erring officials of Respondent No.2 and Respondent No(s).3 & 4."

Learned ASC for State submits that the present case relates to lifting of vehicle by the financer in respect of which loan was availed by the petitioner. On instructions, he further informs that the aforesaid vehicle has never been seized by the police and prayer sought by the petitioner is primarily against the private respondents No. 3 & 4, who are the financers. 4.
After partly making submissions, learned counsel for the petitioner seeks to withdraw the petition with liberty to take appropriate proceedings in accordance with law.
Petition is accordingly disposed of. Pending applications, if any, also stand disposed of.
