Petitioner seeks cancellation of bail granted to respondent herein on 20.05.2023.

Respondent seems to have been granted bail, primarily, for the reason that the manner in which the sample was taken by the petitioner was not found appropriate as it was noted that the contents of various packets were mixed into one and, thereafter, one sample was drawn and sent for analysis. 3.

Fact remains that that bail was granted way back on 20.05.2023 and considerable time has elapsed thereafter and nothing has been brought on record which may indicate that, in the interregnum, the accused has misused the liberty.

After hearing arguments for some time, learned Senior Standing Counsel for petitioner-Bureau, without prejudice to his rights and contentions, does not press for cancellation of bail. 5.

He, however, submits that it be clarified that the abovesaid observation would not prejudice the learned Trial Court, while deciding the case at the final stage.

pressed with the clarification that the observation appearing in the impugned order dated 20.05.2023 shall not prejudice the mind of the learned Trial Court and it would consider the aspect of the sampling at the stage of final arguments in accordance with law, after giving due opportunity of hearing to both the sides.
