This is an application moved on behalf of the applicant/MCD for restoration of the present appeal, which was dismissed for nonappearance of their counsel on 28.03.2025. 3.

No one is present for the respondent despite sending advance notice.

On a perusal of the previous order dated 28.03.2025, as well as the earlier order dated 18.10.2024, it appears that no one appeared on the said two dates for the respondent.

Therefore, for the reasons stated in the application and in the interest of justice, the present application under Order IX Rule 9 of Code of Civil Procedure, 1908, is hereby allowed. The appeal is restored to its original number and position. 6.

The application is disposed of accordingly.
