Learned counsel for the petitioner fairly submits that during the pendency of this petition, the pension account of the deceased petitioner has been made active but during the intervening period the recovery has been made from the pension account, which is illegal. 2.
Learned counsel for the petitioner seeks permission to withdraw this petition with liberty to file fresh with better particulars and challenging the recovery.
