1. Mr. Arvind Nayar, learned senior counsel for the Applicants / Petitioners admits that the cheque for Rs.30 lacs dated 15th August 2019, issued by the Petitioners was dishonoured but explains that this was due to the extenuating circumstances on account of the engineering and sewage work that the Petitioners are undertaking at Jabalpur, not being able to proceed due to incessant rains. He is carrying with him a demand draft (DD) for a sum of Rs.27 lacs, favouring the Respondent Bank of India and prays some more time to pay the balance sum of Rs.66 lacs, which payment had to be completed on or before 31st August 2019, in terms of this Court's order dated 5th August, 2019.
2.The DD for Rs 27 lakhs brought to the Court has been handed over to
counsel for Respondent No.1 without prejudice to their rights and contentions. In view of the reasons explained, the time for the Petitioners to make the balance payment of Rs.66 lacs is extended up to 30th September, 2019. It is made clear that there shall be no further extension of time. The other terms and conditions, as specified in the order dated 5th August, 2019, shall remain unchanged.
