O R D E R

The petitioner has filed the present petition, inter alia, seeking bail in connection with FIR No. 14/2016 under Sections 363/365/368/370/346/310/ 120B/34 IPC, registered at P.S. Alipur.

The said FIR is registered at the instance of the complainant, who had alleged that a nine months old infant had been kidnapped by two persons on the pretext of playing with him.

According to the respondent, the investigation revealed that there were several persons involved in trafficking the child and the complainant's child had been sold to the petitioner. The petitioner and his wife were a childless couple and they were desirous of raising the child. 4.

It is alleged that the petitioner had paid a sum of ₹2,00,000/- for purchasing the infant in question and the infant was recovered from the petitioner.

It is stated that all public witnesses and other material witnesses have already been examined. Only the official witnesses are now required to be examined. The petitioner has been in custody since 05.02.2016. 6.

In view of the aforesaid facts, this Court considers it apposite to allow the present petition and to direct that the petitioner be released on bail. This is considering that there is no allegation that the petitioner has been a part of the gang to pick up children. His role is alleged to be limited to accepting a child on a monetary consideration. As noticed above, the material witness have already been examined and the petitioner has been in custody for more than three and a half years.

In view of the above, it is directed that the petitioner be released on bail on furnishing a personal bond in the sum of ₹50,000/- with one surety of the like amount to the satisfaction of the Trial Court. The petitioner shall also not leave the National Capital Territory of Delhi and shall be present before the Trial Court on all occasions.

Needless to state that if any of the conditions is violated, the bail granted to the petitioner shall be cancelled. 9.

The application is disposed of in the aforesaid terms. 10.
