Learned counsel for the petitioner draws the attention of this Court to an order dated 17.01.2022 wherein the position of law was noted and the matter was adjourned at request of respondent No.2/complainant, who has initiated the subject proceedings under Section 138 of the Negotiable Instruments Act, 1881 to take instructions. The case is pending since then, however, the instructions are still awaited.

Learned APP for State submits that in the FIR proceedings, the closure report has already been filed and consequently, the issue raised does not survive.
