Petition under Section under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC')/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.')/ has been filed on behalf of the Petitioner, Vikas Kaushik for quashing of FIR No.603/2022 dated 01.10.2022 under Section 420/406 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Bhajanpura and all the consequential proceedings emanating therefrom.

On advance Notice, learned APP has appeared and accepts the Notice on behalf of the State.

Respondent No. 2 is present in the Court and endorses that he had given some money to the Petitioner through Property Dealer but he has already received his money and has no objection to the quashing of the said FIR.

It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement dated 13.09.2023, before the Delhi Mediation Centre, Karkardooma Courts, Delhi. In the Settlement, it was inter alia settled between the parties that Rs.22,00,000/- shall be paid by the Petitioner to the Respondent No. 2, towards full and final Settlement. It is stated that the Petitioner has already paid Rs.4,50,000/- to the Complainant. It is further settled between the parties that out of the balance settled amount of Rs.17,50,000/-, the Petitioner shall pay Rs.5,00,000/- by 15.01.2024 to the Complainant and remaining amount shall be paid by the Petitioner in twenty four equal monthly instalments of Rs.50,000/- each, to the Complainant. 8.
The Statement of the parties have already been recorded before the learned Joint Registrar. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 603/2022 dated 01.10.2022 under Section 420/406 of IPC registered at Police Station Bhajanpura and all the consequential proceedings emanating therefrom are quashed The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
