After hearing arguments for some time, learned counsel for the petitioner, without prejudice to his rights and contentions, does not press the present petition.

Fact, however, remains that learned counsel for respondent/plaintiff has also joined the proceedings through video conferencing on advance notice and mere request coming from the side of the petitioner herein is to explore the possibility of amicable settlement, to which even the learned counsel for respondent/plaintiff is not averse to.

In view of the above, with the consent of learned counsel for both the parties, the matter is referred to Delhi High Court Mediation & Conciliation Centre and the parties/respective counsel would appear before the learned Organizing Secretary, Delhi High Court Mediation & Conciliation Centre on 23.05.2025 at 2:00 P.M.

Since the present petition has been disposed of, the outcome of such Mediation may be directly intimated to the concerned Court i.e. learned District Judge (Commercial Courts)-05, South-East District, Saket Courts, New Delhi.

Since the matter is, reportedly, fixed for plaintiff's evidence by the learned Commercial Court and the evidence is to be recorded on 26.05.2025, if the Mediation is not concluded by that day, learned counsel for both the sides, as undertaken today, would make appropriate request to the learned Trial Court to defer the recording of evidence, in order to await the outcome of Mediation.

The petition and the pending applications stand disposed of in aforesaid terms.
