Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 read with Section 582 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the Petitioner, Sunny Yadav for quashing of FIR No.354/2023 dated 07.04.2023 under Section 336/506/34 of the Indian Penal Code, 1860 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(hereinafter referred to as 'IPC') and Section 25/27 of Arms Act, registered at Police Station Jahangir Puri, District North West, Delhi and all the consequential proceedings emanating therefrom, in view of the Settlement dated 21.01.2021.

On advance Notice, learned ASC has appeared and accepts the Notice on behalf of the State.

Brief facts of the case are that the marriage was solemnized between Petitioner/husband and the Respondent No. 2/wife on 12.02.2018, according to the Hindu rites and ceremonies.

It is submitted that the Petitioner and the Complainant, were the husband and wife, who have taken divorce through mutual consent on 22.03.2025. The Petitioner along with his brother, Mr. Karan Yadav (who had died) had gone to the house of the Complainant and the Petitioner had asked her to open the gate, which she was not inclined to do. Mr. Karan Yadav (now deceased) had fired gunshot in the air. On hearing, the Complainant made a call to the PCR. The proceedings against Mr. Karan Yadav, stands abated, on account of his demise. As per the Death Certificate, he had died on 15.08.2024.

It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement dated 21.01.2021. In the Settlement, it was inter alia settled between the parties that the Respondent No.

2/wife and the Petitioner/husband shall dissolve their marriage by decree of mutual consent under Section 13-B(1) and 13-B(2) of Hindu Marriage Act, 1955. The matter inter se the Petitioner and the Complainant, who were husband and wife, already stands settled.

The Statement of the parties have already been recorded before the learned Joint Registrar. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 354/2023 dated 07.04.2023 under Section 336/506/34 of IPC and Section 25/27 of Arms Act, registered at Police Station Jahangir Puri, District North West, Delhi and all the consequential proceedings emanating therefrom are quashed, 12.

Petition is disposed of accordingly.
