Petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed seeking quashing of FIR No. 0001/2023 registered under Sections 174A/229A IPC at P.S. Barakhamba Road and proceedings emanating therefrom in terms of the Settlement dated 05.08.2023. 2.
It is submitted that the present FIR under Sections 174A/229A IPC was the outcome of non-appearance of the Petitioner in the Complaint No. 6193/2023 under Section 138 NI Act. However, the Complaint under Section 138 NI Act has been settled and the Respondent No. 2, who is present in the Court, admits that he has received the entire amount and has no objection to the quashing of the FIR.

Learned Prosecutor also submits that in the factual matters, there is no objection to the quashing of FIR.

The parties are present before this Court today and have been identified by their respective counsel and the Investigating Officer. 5.
In view of the submissions made and also that parties have endorsed the amicable settlement and accepted the terms thereof voluntarily and they submit that the said Settlement has been arrived at between the parties, without any pressure and coercion and that they shall remain bound by the terms of the Settlement, FIR No. 0001/2023 registered under Sections 174A/229A IPC at P.S. Barakhamba Road is quashed alongwith all the proceedings emanating therefrom.

The Petition is accordingly disposed of.
