The present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 482 of the Code of Criminal Procedure, 19732) seeks quashing of FIR No. 103/2019 dated 13th March, 2019, registered at P.S. Fatehpur Beri, Delhi, on the basis of a settlement between the Petitioners and the Complainant (Respondent No. 2). To this effect, a Memorandum of Understanding has been executed between the parties and the same has also been placed on record. 2.
Respondent No. 2 is not present in Court today. The Investigating Officer, ASI Virender Singh, PTC Connaught Place, is present and submits that the Complainant has stated that she no longer wishes to compromise the 1 "BNSS"

matter and is not willing to appear before the Court for recording her statement.

In light of the above, counsel for the Petitioners states that he would like to withdraw the present petition and seeks liberty to apply afresh at a later stage.

The petition is accordingly dismissed as withdrawn, with liberty as prayed for. In the event of a genuine settlement between the Petitioners and the Complainant, they shall be at liberty to approach the Court for appropriate orders.
