O R D E R
% 11.09.2019 A status report dated the 11th September, 2019, authored by Mr. Vishwajeet Ghosal, Director Projects, Prayas, JAC Society, has been handed over in Court today. The same is taken on record. A medical report dated 9th September, 2019, qua Ms. Shivani Prasad, the minor girl, forwarded by Director Institute of Human Behaviour & Allied Sciences (for short 'IHBAS'), is also taken on record. We have interacted with Ms. Shivani Prasad, the minor girl, as well as, her parents, Mr. Dukhchoor Prasad (the petitioner herein) and Ms. Manju, in chambers. The parents have also been apprised of the counselling required by their minor daughter, as well as, the need for her to be permitted to attend the life style Classes, being conducted by the Prayas Children Home for Girls, on every Friday, between 3:00 pm to 5:00 pm.
It is the expressed desire of the parents, as well as, their minor daughter that, she be restored to the care and custody of the former, forthwith. We are assured by the parents that, they shall continue to take all necessary steps, as have been advised and otherwise, to ensure and secure the welfare and well-being of their minor daughter, including accompanying her to IHBAS and permitting her to attend life style Classes at the Prayas Children Home for Girls, as aforementioned.
In view of the foregoing, the present petition is allowed. Ms. Shivani Prasad is directed to be released into the protective custody of her parents, forthwith.
The Government of National Capital Territory of Delhi, is also directed to ensure that the education of Ms. Shivani Prasad at ASMS SKV School, Mahipalpur, where she was last a student, is continued without interruption, in view of the facts and circumstances of the present case. No further directions are called for, in this proceeding. With the above direction, the writ petition is disposed of. Copy of the order be given dasti under signature of the Court Master to learned counsel for the parties.
