% 16.07.2019 The present petition has been filed by the petitioner challenging the communication dated December 19, 2016 whereby the SDMC has refused to sanction the plans for shop cum residential building. Learned counsel for the DDA and SDMC have drawn my attention to a communication dated March 29, 2017 (Annexure R-5) stating that the DDA has clarified that development control norms of shop cum residential plots do not fall under the scope and functions of High Power Review and Monitoring Committee in the DDA. In other words, it is stated by the learned counsel for the SDMC, on instructions from Mr. P.K. Rastogi, AE for SDMC, now the SDMC has power to sanction the plans for shop cum residential building. He also concedes that a fresh application has been filed

by the petitioner, which is under consideration of the SDMC. According to him, the said application shall be considered in terms of the rules and regulations and a decision shall be taken, as expeditiously as possible. On this submission of learned counsel for the SDMC, Mr. Mishra, learned counsel for the petitioner states, nothing further survives in the petition and he wishes to withdraw the same. The petition is dismissed as withdrawn.
