O R D E R

% 19.03.2024 During the course of the hearing, learned counsel for the plaintiff submits that without prejudice to his rights and contentions, the present suit may be transferred to the Court of Learned District and Sessions Judge, South District, Delhi.

In brief, the present suit was instituted on 08.08.2023, and the objection taken by the defendant was in fact, the Court of original jurisdiction in the present case is of the Court of Learned Principal District & Sessions Judge, South District.

In view of the submissions made, in the exercise of its power under Section 24 of CPC, this Court transfers the present suit to the Court of Learned Principal District & Sessions Judge, South District, to be tried from The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the stage it is at present.

It is made clear that this Court has not gone into the merits of the present case and no expression made herein shall be tantamount to the merits of the case and the learned Trial Court shall adjudicate the same in accordance with the law.

Registrar General of this Court is directed to send the record of the case to the Court of Learned Principal District & Sessions Judge, South District.

Parties are directed to appear before the Court of Learned Principal District & Sessions Judge, South on 03.04.2024. Learned counsel for the plaintiff submits that in these circumstances, he does not press the application for amendment bearing I.A. 840/2024. Accordingly, the I.A. 840/2024 is dismissed as withdrawn. Written statement already filed by the defendant be taken on the record and delay is condoned bearing I.A. 872/2024 and counterclaim be also transferred along with present suit to the Court of learned Principal District & Sessions Judge, South.
