O R D E R

% 09.08.2019 BAIL APPLN. 1870/2019 & Crl.M(B) 1394/2019 Petitioner seeks bail in FIR No. 347/2017, under Section 302/34 of IPC, registered at police station K.N.Katju Marg, New Delhi is sought while claiming that petitioner is in custody for the last two years. Learned Additional Public Prosecutor for respondent-State points out that trial of this case is at the final stage. Since the trial of this case is at its fag end, therefore, this court is not inclined to prejudge prosecution case to grant regular bail to petitioner.

At this stage, counsel for petitioner prays for interim bail for 15 days on the ground that petitioner's wife is to be operated upon for breast

cancer on 11th August, 2019. The factum of operation of petitioner's wife stands verified, as status report to this effect has been handed over to the Court, which is taken on record.

In the facts and circumstances of this case, the date of 21st August, 2019 fixed in this application is cancelled and alternate prayer made for interim bail is considered.

Upon hearing and without commenting on the merits of the case, it is directed that petitioner be forthwith released on interim bail for a period of two weeks (from the day of release) subject to his furnishing bail bond in the sum of ₹20,000/- with one local surety in the like amount to the satisfaction of the trial court.

The applications are accordingly disposed of. A copy of this order be given dasti under the signatures of Court Master to counsel for petitioner.
