The petitioner has assailed order dated 15.04.2025 passed by the learned trial court, whereby the application of respondent/defendant under Order XXVI Rule 9 CPC was allowed, thereby appointing a Local Commissioner to visit and ascertain the current status and condition of the suit property. Broadly speaking, it appears that the suit property was earlier directed to be entrusted to a Receiver, after which it was sealed, after which there was complaint of the present petitioner/plaintiff that some of the articles had been removed from the suit property. 2.

After addressing partly, learned counsel for petitioner seeks permission to withdraw this petition unconditionally. 3.

Accordingly, the petition and the pending applications are dismissed as withdrawn.
