The appeal impugns a judgment and decree of dismissal of a claim for specific performance of an agreement of sale of immovable property and instead granting the relief of refund of earnest money paid with interest. 3.

Though the appeal is pending in this Court since 2012 along with an application for condonation of 9 days delay in filing and 157 days delay in re-filing thereof but the appellant has not been taking steps in the appeal. It appears that the appellant is not interested in pursuing the appeal. 4.

Dismissed in default.
