This application has been jointly filed by the parties placing a settlement arrived at between them, which has been reduced into writing on 22nd February, 2016. The settlement is annexed as Anneuxre A to this application. Parties are represented by counsel and submit that they are in a position to identify the signatures of their respective clients on the settlement agreement as well as affidavits.

The signatures of Sh.Deepak Bhatnagar (respondent herein) on every page of the settlement application and affidavit are identified by his counsel Mr.Arjun Singh Bhati, Advocate. Mr.Abhimanyu Mahajan, Advocate so identifies the signatures of Sh.Arjun Sharma and Sh.Manish Goel (who is present in the Court).

The settlement appears to be bona fide and entered into between the parties without any force, coercion or undue influence. We are informed that the parties have already commenced working out the terms of settlement. There is no legal impediment for taking the settlement agreement on record. It is so directed.

This application is allowed.

FAO(OS) 142/2014 In view of the prayer made in the application CM No.7558/2016 to the effect that the appeal be disposed of in terms of the settlement agreement dated 22nd February, 2016 and the order passed thereon, the present appeal is disposed of in terms of the settlement agreement dated 22nd February, 2016. CM No.5019/2014 In view of the orders passed on the appeal, this application does not survive for consideration. The same is dismissed as infructuous.
