% 26.11.2025 The present matter has been taken up today i.e. 26th November, 2025, as 25th November, 2025 was declared a holiday on account of 350th Anniversary of 'Guru Teg Bahadur's Martyrdom Day.' I.A. 29439/2025 1.

This application has been filed seeking advancement of the date of hearing in the suit in view of the settlement arrived at between the parties. 2.

For the reasons stated in the application, the same is allowed and the suit is taken up for hearing today itself.

CS(OS) 323/2025 3.

Counsel for the parties submit that parties have settled their disputes before the Delhi Mediation Centre, Saket Courts, New Delhi. 4.

record ('Settlement Agreement').

The Settlement Agreement has been signed by the plaintiffs and the defendants.

The plaintiffs as well as the defendant no.1 are present in Court and affirm the terms of the Settlement Agreement. 7.

I have gone through the terms of the settlement and find the same to be lawful.

The suit is decreed in terms of the aforesaid Settlement Agreement. 9.

The Settlement Agreement shall form part of the decree. 10.

The parties shall remain bound by the terms of the Settlement Agreement.

The defendant is granted time till 15th December, 2025 to make the payments under the settlement.

12.

In view of the settlement arrived at between the parties, interim order passed on 20th May, 2025 shall stand vacated. 13.

Since the matter has been settled in mediation proceedings, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870, read with Section 89 of the Code of Civil Procedure, 1908. 14.

All pending applications stand disposed of.
