By way of the present petition filed under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner is seeking following reliefs: "a.) Issue a writ in the nature of mandamus directing the respondent to release the petitioner on Parole for 4 weeks on the ground of social ties and for filing of Special Leave Petition before Hon'ble Supreme court And b.) Pass any other order or further orders, which this Hon'ble Court deems fit and proper in the interest of justice" 2.

This Court's attention has been drawn to an order dated 03.04.2025, passed in W.P.(CRL) 845/2025 by the Co-ordinate Bench of this Court, wherein it was directed as under:

"4.

It is pointed out that two years since the said punishment has now lapsed. In view of the same, let the present petition be treated as a fresh representation for parole and be placed before the Competent Authority. Authority shall decide the said representation within a period of 3 weeks under intimation to the petitioner."

The present petition was filed on the ground that despite lapse of a period of three weeks, the application of the petitioner had not been decided. However, during the pendency of the present petition, the said application/ representation has been decided by the competent authority and the same has been rejected.

In these circumstances, the learned counsel for the petition seeks to withdraw the present petition along with the liberty to file a fresh petition challenging the aforesaid order passed by the competent authority.

5. In view of the above statements, the present petition is dismissed as withdrawn with liberty as prayed for.
