The present petition under Sections 10 and 12 of the Contempt of Courts Act, 1971 seeks the following prayers: - "a. Issue notice to the contemners calling upon them to show cause as to why they should not be tried for Contempt of Court and punish the Contemners after following the procedure established by law; b. Initiate contempt proceedings against Respondent Contemner No. 2 to 7 and further direct the arrest and detention of the said persons until compliance of order dated 26-11-2024 passed by this Hon'ble Court in W.P. (C) No. 393/2023;

c. Grant costs of the entire litigation right from the inception till the present petition in favour of the Petitioner and against the Contemners to be paid jointly and severally by the Contemnors; d. Pass any other order as this Hon'ble Court may deem fit in the light of the present facts and circumstances." Vide order dated 26.11.2024 passed in W.P.(C) 393/2023, learned Division Bench of this Court had passed the following directions: - "1 Present petition has been filed challenging the order dated 21 October, 2022 passed by Delhi Cooperative Tribunal in Appeal No II 0/2021/DCP, whereby the award dated 15th November, 2021 passed by the sole Arbitrator, was set aside and elections of respondent no.l society for various posts held on 3rd January, 2020 were upheld.

2 After some arguments, learned counsel for the petitioners states that petitioners are willing to deposit the share money of Rs.15,000/- as demanded by the respondent society provided their membership, voting rights and right to contest are protected/restored.

3 Learned counsel for respondent society fairly states that m the event the share money of Rs.15,000/- is paid by the petitioners, the respondent society has no objection to restoration of their membership, voting rights as well as right to contest elections.

4. Recording the aforesaid consent and holding the parties bound by the same, the present writ petition is disposed of." 4.

In pursuance of the directions passed vide order dated 20.11.2025, the President of the Vikalp Cooperative Group Housing Society Ltd. is present in-person in the Court today.

Learned counsel appearing on behalf of the respondent No.1/Vikalp Cooperative Group Housing Society Ltd. submits that the compliance affidavit has been filed; however, the same is not on record. A copy of the same has been handed up in the Court today and is taken on record. Attention of this Court has been drawn to the list of member/shareholders as on 24.11.2025 forwarded by the respondent/Vikalp Cooperative Group Housing Society Ltd. to the RCS reflecting the name of the petitioner at serial No. 50. The said document further records that the membership of the petitioner at serial No. 50 was restored in compliance of the directions passed aforesaid order dated 26.11.2024 in W.P.(C) 393/2023.

It is further pointed out that the said membership has been restored despite the petitioner's non-payment of share money of Rs.15,000/-. 7.

Learned counsel appearing on behalf of the petitioner submits that he shall deposit the share money of Rs.15,000/- by way of Demand Draft in favour of respondent No.1 within a period of 1 week from today. 8.

In view thereof, learned counsel for the petitioner does not press this petition any further.

The present petition is disposed of as not pressed. 10.
