This petition is filed by the Petitioner under Section 9 of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking restraint order against the Respondents from assigning, transferring, selling, dealing with or disposing in any manner all or any part of the pledged securities and/or creating or attempting to create or permit to create any security or interest of any kind in favour of any other person as also restraining from acting in pursuance of the Advertisement dated 01.08.2023. Learned counsel appearing on behalf of Respondent No. 2, on instructions, submits that Respondent No. 2 shall not proceed further with the Advertisement dated 01.08.2023 appended as Document-1 to this petition, at this stage.

Learned counsel for Respondent No. 1, on instructions, states that Respondent No. 1 is not proposing to sell or transfer the shares of Respondent No. 1 pledged with the Petitioner. 4.

In light of these submissions made by learned counsel for Respondent No. 1, Mr. Nalin Kohli, learned Senior Counsel for the Petitioner seeks to withdraw this petition.

Accordingly, the petition is disposed of as withdrawn. Needless to state that the Petitioner will be at liberty to take recourse to appropriate remedies in case of any further or fresh cause of action.
