After canvassing some arguments, learned counsel for the Appellant, on instructions from the Appellant, withdraws the present appeal with liberty to pursue the suit filed by the Appellant for declaration and mandatory injunction, which is pending before the Saket District Court. 2.

The appeal is disposed of as withdrawn, permitting the Appellant to pursue his remedy in the suit filed before the Saket Court, being CS(DJ) 9163/2016.

Needless to state that withdrawal of this appeal will be without prejudice to the rights and contentions of the Respondent to take the permissible objections pending suit, before the Saket Court.
