CORAM:

HON'BLE MR. JUSTICE NAVIN CHAWLA

O R D E R

% 15.01.2020 CM 1526/2020(for recall of order dated 13.08.2019 on behalf of R4), CM 1527/2020 (delay of 53 days in filing of CM 1526/2020) and CM 1528/2020 (delay of 16 days in re-filing of CM 1526/2020) These applications have been filed by the respondent no.4 seeking recall of the order dated 13.08.2019 passed by this Court in the above Writ Petition.

The order dated 13.08.2019 dismissed the writ petition filed by the petitioner as withdrawn with liberty to the petitioner file an appropriate action for seeking compensation from the respondent authorities.

The application asserts that the petitioner is misusing this order as a justification for her non-appearance in criminal trial pending on the FIR No.529/2018 dated 15.12.2018, P.S. Mianwali Nagar. In my view, the order dated 13.08.2019 was passed merely on the submission made by the learned counsel for the petitioner allowing the petitioner to withdraw the said petition. It did not make any comment on the merits of the claim made by the petitioner and

therefore, does not deserve any recall at the behest of the respondent no.4.

In view of the above, the learned counsel for the respondent no.4 prays for leave to withdraw the present applications. The same are dismissed as withdrawn.
