% 19.02.2018 Respondent no.2- is present in Court along with his counsel and has been identified by SI Kishor Kumar of police station Patel Nagar. Respondent no.2 submits that he has settled the matter with the petitioner vide Settlement Agreement dated 20th January, 2018 of his own free will and without any undue force, pressure or coercion. He further submits that he has already received `1.5 lacs from the petitioner out of the total settled amount of `3 lacs. Petitioner has handed over a demand draft of `1.5 lacs to the respondent today in Court towards the balance settled amount. Respondent no.2 submits that entire settled amount stands paid and he has no objection in case FIR is quashed. Affidavit of respondent no.2 in support of the petition has also been placed on record.
Keeping in view the settlement arrived at between the petitioner and respondent no.2 voluntarily, I am of the view that no fruitful purpose would be served in keeping the present criminal proceedings pending.
Accordingly, in the interest of justice, FIR No. 408/2016 under Sections 420 IPC registered at police station Patel Nagar, which is at the investigation stage, is quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
