Learned Counsel for the Petitioner has drawn the attention of this Court to Order dated 30.01.2024, passed by a co-ordinate Bench of this Court in BAIL APPLN. 1835/2023, filed by the co-accused. In the said Order this Court had given liberty to the Petitioner therein to approach this Court once again in case the trial is not concluded within a period of six month.

It is stated by the learned APP for the State that out of the total 40 witnesses, 25 witnesses have been examined.

Learned Counsel for the Petitioner seeks permission to withdraw the present Petition with liberty approach the competent Court by filing a fresh application for bail in case conclusion of the trial is delayed. 4.

Considering the fact that the Petitioner is in custody for 6 years and 7 months now, the Trial Court is requested to expedite the trial and conclude the same within six months from today.

It is made clear that this Court has not expressed any opinion on the merits of the case.
