The present petition has been filed under Article 227 of the Constitution of India seeking directions for disposal of the divorce petition bearing HMA no.45/2019 titled as ―Anil Soni vs. Nidhi Soni‖ along with the application under Section 24 and 26 of the Hindu Marriage Act, 1955 (in short ―HMA Act‖) within a period of six months or as expeditiously as possible.

Learned counsel for the petitioner submits that the petitioner and the respondent got married on 27.11.2004 according to Hindu rites and rituals. The parties have two children out of the said wedlock. 3.

Learned counsel further submits that in the year 2017, the petitioner filed a divorce petition before the learned Judge Family Court, Patiala House Courts, New Delhi under Section 13 (1)(i-a) of HMA Act seeking divorce on the grounds of mental cruelty.

It is submitted that till date, issues have also not been framed by the Family Court and the matter is at the stage of hearing arguments on four miscellaneous applications.

Learned counsel submits that evidence can be led simultaneously along with disposal of the aforesaid applications. In these circumstances, directions be issued to the learned Judge, Family Court to dispose of the petition along with the applications within a time frame of six months since respondent is enjoying the payment of ad-interim maintenance. 6.

In view of the above, the learned Judge, Family Court to dispose of the divorce petition as well as the applications expeditiously. No further directions are required.

The present petition stands disposed of.
