% 31.05.2024 CM APPL. 31873/2024 (Seeking withdrawal of captioned appeal and refund of court fee) The instant application under Section 151 Code of Civil Procedure, 1908 read with Section 16 of the Court Fees Act, 1870 has been filed on behalf of the appellant/applicant for disposal of the instant appeal in terms of settlement agreement dated 19th December, 2023. Learned counsel appearing on behalf of the appellant is submitted that in view of the settlement agreement dated 19th December, 2023, the instant appeal may be disposed of.

The appellant is present before this Court and has been identified by her counsel. In view of the Settlement Agreement dated 19th December, 2023, the instant appeal stands disposed of in terms of the Settlement Agreement dated 19th December, 2023 as nothing survives for further adjudication in the instant appeal and the parties are also directed to abide by the terms and conditions of the Settlement Agreement dated 19th December, 2023. Accordingly, the instant application stands disposed of. RFA 285/2020, CM APPL. 30322/2020 & CM APPL. 31874/2024 In view of the order passed in CM APPL. 31873/2024, the instant appeal stands disposed of as nothing survives for further adjudication in the instant appeal.

Learned counsel appearing on behalf of the appellant prayed for liberty to file appropriate application to withdraw the Court fee. Liberty is granted.
