Petition under Section 482 of the Code of Criminal Procedure, 1973 has been filed by the Petitioner seeking quashing of FIR No. 0149/2021 under Sections 406/420 IPC registered at P.S. Barakhambha Road and all proceedings arising therefrom in terms of the Settlement Deed cum MoU dated 21.04.2025.

The FIR No. 0149/2021 was got registered under Sections 406/420 IPC at P.S. Barakhambha on the basis of complaint made by the Complainant for criminal breach of trust, cheating, forgery, mischief and fraud committed by the Petitioner.

The Petitioner is present in person and the Respondent No. 2 has appeared through VC and have been identified by their counsel and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The statements of both the parties have been recorded before the learned JR.

The matter is truly in terms of Settlement Deed cum MoU dated 21.04.2025 and a sum of Rs.12 Lacs has been received by the Complainant, who endorses the Settlement Deed cum MoU dated 21.04.2025. It is submitted on behalf of the Complainant that it has no objection if the FIR is quashed against the Petitioner on account of the Settlement already arrived at between the parties.

In view of the submissions made, the Petition is allowed. Accordingly, FIR No. 0149/2021 under Sections 406/420 IPC registered at P.S. Barakhambha Road with all the subsequent proceedings is hereby quashed.
