% 29.07.2016 By the present petition, the petitioner seeks anticipatory bail in case FIR No. 845/2015 registered at PS Nihal Vihar under Sections 354A/323/341 IPC and 12 POCSO Act.
Learned counsel for the petitioner submits that the petitioner has joined the investigation as and when directed. In the alleged incident, the petitioner and his wife were also injured, however, no case was registered and for which wife of the petitioner has already filed a petition under Section 156 Cr.P.C.
Learned APP refers to the status report and submits that the allegations against the petitioner are that he entered into the house, which was objected to by the complainant. When they went to complain to the
petitioner's wife, they were given beatings, as a result of which they sustained injuries.
I have gone through the MLCs of all the four witnesses of the complainant's side, the petitioner and his wife. Injuries have been received by both the parties.
One of the grievances raised in the status report is that the petitioner had changed his address and his fresh address was not available. Learned APP, on instructions from the Investigating Officer, states that petitioner has now informed his correct address and has joined the investigation.
Considering the facts and circumstances of the case I find it a fit case to grant anticipatory bail. In the event of arrest, the petitioner will be released on furnishing a personal bond in the sum of `25,000/- with two sureties in the like amount to the satisfaction of the Arresting Officer/ SHO of the Police Station concerned, further subject to the petitioner joining the investigation as and when directed by the Investigating Office and that he will not leave the country without the prior permission of the court concerned.
Bail application is disposed of.
