An Affidavit has been filed 13.02.2026 by the Plaintiff stating that due to his current financial status and deteriorating health, he is not able to continue with the proceedings, and therefore, seeks permission to withdraw the present Suit. The Affidavit has been signed on 27.01.2026 by the Plaintiff and notarized by Mr. Paras Kumar Jha, Advocate, having Notary Registration No. 46196 and identified by Mr. Rahul Dubey, Advocate (Enrollment No: D/3683/15).

Today, the Plaintiff has joined the Court proceedings through videoconferencing and has been identified by his Counsel, Mr. Rahul Dubey, Advocate, who states that the Plaintiff was unable to come to the Court because of the physical condition of wife.

The Plaintiff states that he has signed the Affidavit on his own will and without any undue influence, coercion or threat or any other compulsion.

Accordingly, the Suit is dismissed under Order XXIII Rule 1 (4)(a) of the CPC. The Plaintiff understands that since the Suit stands withdrawn, he is precluded from instituting a fresh Suit for the same cause of action. 6.
