% 21.01.2025 I.A. 1552/2025 (under Order XXIII Rule 3 CPC) 1.

This is a joint application filed under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 ('CPC') for the recording of settlement arrived at between the plaintiff and the defendants.

The application has been duly signed by the authorised representative of the plaintiff and defendant no. 2, who is also the director of defendant no.1 company, and is also supported by their respective affidavits. 3.

The terms of the settlement are mentioned in paragraph no. 5 of the application.

I have gone through the terms of the settlement and find the same to be lawful.

The parties shall remain bound by the terms and conditions of the settlement.

In light of the order passed in I.A. 1552/2025 above, the present suit is decreed in terms of prayer clauses 59 (a), (b), (c) and (e). The aforesaid application shall form part of the decree.

Since the matter has been settled at an initial stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870.
