The present application has been filed under Order XXIII Rule 1 of the Code of Civil Procedure, 1908, seeking withdrawal of the present suit since the parties have settled their disputes. 2.

It is stated that in terms of the settlement, the plaintiff has agreed to withdraw the present suit.

Notice is accepted by the counsel appearing on behalf of the defendants.

Counsel for the defendants states that the defendants have no objection if the present suit is withdrawn.

Accordingly, the present application is allowed and the plaintiff is permitted to withdraw the present suit.

In view of what is stated above, the present suit is dismissed as withdrawn.

Since the suit has been settled at a very early stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16A of the Court Fees Act, 1870, as applicable to Delhi read with Section 89 of the Code of Civil Procedure, 1908.

All pending applications stand disposed of.

10.

The dates fixed in the case stand cancelled.
