1. The present application has been filed under Section 438 Cr.P.C. seeking grant of anticipatory bail in case FIR no. 250/2023 registered under Section 420/406/120B IPC at PS: Dwarka South.

2. The learned APP for the State submits that, as per the inquiry conducted by the police, Mr. Darshan Kumar, the complainant in the present case, is no longer alive.

3. Let the verification record be brought on record.

4. Learned APP on instructions submits that the investigation in this case is continuing. However, it has been stated that the petitioner is joining the investigation.

5. In view of the peculiar facts and circumstances, the order dated 14.08.2023 is confirmed and the petitioner is admitted to anticipatory bail upon furnishing a personal bond of Rs. 20,000/- with one surety of the like amount to the satisfaction of the concerned learned Trial Court The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. and the conditions imposed by the Investigation Officer and the appellant shall provide his mobile number at the time of furnishing the bail bond, and subject to the following further conditions: a) the petitioner shall cooperate in the investigation and appear before the Investigating Officer of the case as and when required; b) the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case; c) the petitioner shall provide his/her mobile number(s) to the Investigating Officer and keep it operational at all times; d) the petitioner shall remain available on the address, to be provided to the investigation officer and shall not leave NCT of Delhi without the permission of the learned Trial Court;

e) In case of change of residential address and/or mobile number, the petitioner shall intimate the same to the Investigating Officer/Court concerned by way of an affidavit;

f) the petitioner shall also inform the investigation officer about any change in their address.

6. Copy of the order be sent to the concerned Jail Superintendent for information and compliance.
