versus UNION OF INDIA AND ANR.

..... Respondents Through:

Ms Arti Bansal, Advocate for UOI.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 02.08.2019 1.

The petitioner has filed the present petition, inter alia, impugning a notice dated 05.04.2019, inter alia, directing the petitioner to vacate the shop allotted to the petitioner at the Base Hospital, Delhi, by 30.04.2019. 2.

The petitioner claims that he was running a general store from the shop in question. The contract granting license for using the shop was executed between the petitioner and the respondent authorities on 01.04.2018. In terms of the said license, the petitioner was granted permission to carry on the said business from the shop for a period of eleven months commencing from 01.04.2018 to 28.02.2019. Concededly, the said period has expired.

3.

It is settled law that the licensee does not acquire any right, title or interest in the property licensed. In this view, this Court is unable to accept

that the petitioner has any right to continue occupying the shop in question. This Court is also informed that the respondent authorities have allotted the shop to another eligible applicant.

4.

The petition is unmerited and the impugned notice cannot be faulted. The petition and the applications are, accordingly, dismissed. VIBHU BAKHRU, J AUGUST 02, 2019 RK
