Heard learned counsel appearing on behalf of the parties. 2.

The Court also takes note of judgment dated 19.05.2025 passed in ARB.P. 762/2025, wherein, while taking note of the Memorandum of Understanding dated 01.12.2024, the Court has appointed Mr. Shreeyash Lalit, Advocate as the Sole Arbitrator.

The instant petition is also emanated from the said Memorandum of Understanding dated 01.12.2024.

In view of the aforesaid, it would be apposite to request the learned Arbitrator as appointed in ARB.P. 762/2025 to treat the instant petition, as well, as an application under Section 17 of the Arbitration and Conciliation The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Mr. Jeevesh Nagrath, learned senior counsel for the petitioner, however, expresses some urgency and contends that though the petitioner is in possession of the premises in question, the respondent is trying to forcibly enter into the petitioner's premises.

The said contention is refuted by Mr. Pankaj Seth, learned counsel for the respondent.

However, the Court deems it appropriate to request the learned Arbitrator to deal with Section 17 application with due expedition. 8.

Leaving all rights and contentions of the parties open, the instant petition stands disposed of.
